The applicant’s response to the Final Refusal Office action, dated April 4, 2003, was filed on July 18, 2003. The examining attorney has reviewed the applicant’s amendments in favor of registration. In the Final Refusal, the examining attorney indicated that the applicant’s services relating to operation of electrical systems for others must be clarified and also indicated that said services should be classified in International Class 35. In its response, the applicant has amended such services to “operation of electrical generation systems for others,” but has failed to reclassify the same.
Consequently, in accordance with the authorization granted by TMEP section 707.02, the application has been AMENDED as indicated below. No response is necessary unless there is an objection to the amendment. If there is an objection to the amendment, the applicant should notify the examining attorney immediately.
“RETAIL STORE SERVICES FEATURING LIGHTING; PROCUREMENT, NAMELY, PURCHASING ELECTRICITY AND NATURAL GAS FOR OTHERS; OPERATION OF ELECTRICAL GENERATION SYSTEMS FOR OTHERS” in International Class 35.
“MAINTENANCE OF ELECTRICAL SYSTEMS; MAINTENANCE OF LIGHTING APPARATUS; CONSTRUCTION OF ELECTRICAL SYSTEMS” in International Class 37.
FEE INCREASE EFFECTIVE JANUARY 1, 2003 (FOR INFORMATION ONLY)
Effective January 1, 2003, the fee for filing an application for trademark registration will be increased to $335.00 per International Class. The USPTO will not accord a filing date to applications that are filed on or after that date that are not accompanied by a minimum of $335.00.
Additionally, the fee for amending an existing application to add an additional class or classes of goods/services will be $335.00 per class for classes added on or after January 1, 2003.
