I.         INTRODUCTION

 

            This Office Action responds to the applicant’s correspondence of September 23, 2003.  The examining attorney acknowledges and accepts the applicant’s amendment to correct the German registration number, and to add two classes of goods and services in International Classes 20 and 37, and these changes have been made of record.  Although the applicant in its response has made a number of helpful, clarifying amendments to the identification, there remain portions of the identification that are unacceptably indefinite.  Accordingly, the examining attorney herein continues and makes FINAL his refusal with respect to the identification.

 

II.        FINAL REFUSAL -- IDENTIFICATION OF GOODS AND SERVICES

 

            It is the applicant's responsibility to identify the goods and services as clearly, accurately and concisely as possible.  TMEP Section 1402.01(d).  See Procter & Gamble Co. v. Economics Laboratory, Inc., 175 USPQ 505 (TTAB 1972); In re Cardinal Laboratories, Inc., 149 USPQ 709 (TTAB 1966); California Spray-Chemical Corp. v. Osmose Wood Preserving Co. of America, Inc., 102 USPQ 321 (Comm'r Pats. 1954); Ex parte A.C. Gilbert Co., 99 USPQ 344 (Comm'r Pats. 1953).  Furthermore, the identification of goods and services must be specific and definite.  In re Societe Generale des Eaux Minerales de Vittel S.A., 1 USPQ2d 1296 (TTAB 1986), rev'd on other grounds, 824 F.2d 957, 3 USPQ2d 1450 (Fed. Cir. 1987).  TMEP Section 1402.01.  To assist the applicant in this goal, the examining attorney herein offers the following language as an acceptable alternative.

In International Class 37;  maintenance of vehicle fleets; maintenance of telecommunications equipment; maintenance of computer hardware.

 

In International Class 38;  electronic transmission of messages, images and data via the Internet;  online news analysis and features distribution; broadcasting programs via a global computer network; electronic transmission of data and documents via computer terminals; telecommunications services, namely, transmission of voice and data by means of telephone, telegraphic, cable, and satellite transmissions; delivery of messages by electronic transmission; electronic transmission of messages and data by means, including by means of a global computer network; electronic store-and-forward messaging; telecommunications consultation, namely, consultation in the fields of electronic transmission of messages and data; telecommunications gateway services; providing multi-user access to a global computer information network; Internet and online services, namely, the electronic transmission of messages and images; providing multiple user dial-up and dedicated access to the Internet.

 

In International Class 39;  freight transport by means of trucks, ships, planes, motor vehicles, buses, railway and foot; transport brokerage; packaging articles for transportation; storage of letters, parcels and packaging articles; storage of goods in warehouses, distribution centers and production facilities; providing storage information; rental of storehouse and warehouse space; providing transportation information; courier services; postal services, namely, parcel delivery, packaging articles for transportation, rental of mail boxes; freight ship transport.

 

In International Class 41;  education services, namely, conducting classes, seminars, conferences, workshops in the field of supply chain management, logistics, transportation, warehousing, trade rules and regulations and the distribution of course materials in connection therewith.

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. Section 2.71(b); TMEP section 804.09.  Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.

III.            CONCLUSION

 

            The examining attorney herein makes FINAL the refusal to register.  Please note that the only appropriate responses to a final action are either (1) compliance with the outstanding requirements, if feasible, or (2) filing of an appeal to the Trademark Trial and Appeal Board.  37 C.F.R. Section 2.64(a).  If the applicant fails to respond within six months of the mailing date of this refusal, this Office will declare the application abandoned.  37 C.F.R. Section 2.65(a).
