The assigned examining attorney has reviewed the statement of use filed on October 6, 2003 in this now revived application, and has determined the following.

 

Verified Date of First Use in Commerce Must be Provided

 

Although the statement of use specifies the date of first use anywhere, it omits the required date of first use in commerce.  Trademark Act Section 1(d)(1), 15 U.S.C. §105l(d)(1); 37 C.F.R. §2.88(b)(1); TMEP §§903, 903.02 and 1109.09(a).  Applicant must specify the date of first use of the mark in commerce. This date must be supported by a notarized affidavit or a signed declaration under 37 C.F.R. §2.20.  37 C.F.R. §2.71(c); TMEP §903.
