The Office Action of June 27, 2003 has been carefully reviewed and
the following Remarks are in response thereto.
REMARKS
Attached are substitute specimens that show use of the mark as it
appears on the drawing. The applicant also verifies that the substitute
specimens were in use in commerce prior to the expiration of the time
allowed to applicant for filing a statement of use.
DECLARATION
Gerald T. Shekleton, being hereby warned that willful false
statements and the like so made are punishable by fine or imprisonment, or
both, under Section 1001 of Title 18 of the United States Code, and that
such willful false statements may jeopardize the validity of the application
or any registration resulting therefrom, declares that he is Attorney of
Record of Applicant Corporation and is properly authorized to execute this
declaration on behalf of said Corporation; that he believes that said
Corporation is the owner of the trademark sought to be registered; and, that
no other person, firm, corporation or association, to the best of his
knowledge and belief, has the right to use such trademark in commerce,
either in the identical form or in such near resemblance thereto as to be
likely, when used in connection with the goods of such other person, to
cause confusion or to cause mistake, or to deceive; that the facts set forth
in this application are true, that all statements made of his own knowledge
are true, and that all statements made on information and belief are
believed to be true.
