This letter is in response to applicant’s correspondence filed on January 2, 2003.

 

The assigned examining attorney has reviewed the referenced correspondence and determined the following.

 

Foreign Registration

 

The examining attorney accepts applicant’s foreign registration.

 

Drawing

 

The examining attorney accepts applicant’s amended drawing.

 

Submission of Signature and Date of Execution

 

The examining attorney accepts applicant’s submission of a signed and dated application.

 

Identification of Goods

 

The examining attorney finds applicant’s identification of goods in International Class 016, 020, and 021 unacceptable.  Applicant has neither acknowledged nor amended its identification of goods in accordance with any of the examining attorney’s requirements or suggestions. 

 

It appears that applicant ignored the requirements, as there are no inquiries found included in the response for clarification of any of the identification requirements.  Therefore, the examining attorney maintains and makes FINAL the above-indicated identification requirements.

 

Please note that the only appropriate responses to a final action are either (1) compliance with the outstanding requirements, if feasible, or (2) filing of an appeal to the Trademark Trial and Appeal Board.  37 C.F.R. Section 2.64(a).  If the applicant fails to respond within six months of the mailing date of this refusal, this Office will declare the application abandoned.  37 C.F.R. Section 2.65(a).
