NOTICE OF SUSPENSION

 

This application has been reassigned to the examining attorney listed below.  The refusal based on the likelihood of confusion with the prior pending Application Ser. No. 75939368 is withdrawn.  The following issues remain outstanding.

 

Possible Confusion with Pending Mark

Action on this application is suspended pending the disposition of Application Serial No. 78066262.   The applicant's filing date is subsequent to the filing date of 78066262.  The latter mark, if and when it registers, may be cited against this application.  See 37 C.F.R. §2.83.  A copy of information relevant to this pending application was sent to the applicant with the Office action dated July 1, 2002.

 

Refusal Based on Section 2(d) - Likelihood of Confusion

The examining attorney continues the refusal of  registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d), because the applicant's mark, when used on the identified goods, is likely to be confused with the registered mark in Registration No. 1596038.  TMEP sections 1207.01 et seq.  A copy of this registration was sent to the applicant with the Office action dated July 1, 2002.
