The Registrant respectfully requests that the registration be amended to correct a mistake through the fault of the Applicant. The mistake occurred in good faith and does not require such changes to the registration as to require republication of the mark. The application for registration was originally filed by Scott Pet Products, Inc. During the pendency of the application, the mark was twice assigned to Vision International, LLC. The first assignment was on April 1, 2003. Vision International, LLC was identified as an Oklahoma corporation. This was incorrect as the assignee was a limited liability company. The second assignment identified Vision International, LLC as a Texas corporation. The second assignment was made on November 4, 2003. Both of these assignments were recorded in the Patent and Trademark Office. After the registration of the subject mark, it was discovered that the actual legal name of the assignee was Vision Ostrich International, LLC, an Oklahoma limited liability company. Vision Ostrich International, LLC did business as both Vision International and Vision International, LLC. Neither Vision International nor Vision International, LLC were legal entities. A Declaration from Frank Jay Hague, sole manager of the assignee, is enclosed herein and sets out the facts. The mistake in the name of Scott Pet’s assignee occurred in good faith. This is not an intent to substitute one entity for another as Vision International, LLC did not exist. It was a trade name of Vision Ostrich International, LLC. Furthermore, a corrective assignment from Scott Pet Products, Inc. to Vision Ostrich International, LLC was made, effective March 31, 2003. This assignment predates the other two assignments by Scott Pet Products, Inc. and is recorded at reel/frame 4089/0010. After the registration, Vision Ostrich International, LLC assigned the trademark to Frank Jay Hague, which assignment is effective June 30, 2006 and is recorded at reel/frame 4089/0288. Mr. Hague assigned the trademark to Vision Overseas, LLC, a Texas limited liability company, which assignment is effective December 11, 2006 and is recorded at reel/frame 4089/0698. Vision Overseas, LLC is the current owner of the mark and registration. It is respectfully requested that the certificate of registration be corrected to show that the Registrant was Vision Ostrich International, LLC, an Oklahoma limited liability company, and that a new certificate of registration showing the proper owner be issued.
