EXAMINER’S AMENDMENT

The application has been AMENDED as indicated below. Please note that if the identification of goods or services has been amended below, any future amendments must be in accordance with 37 C.F.R. 2.71(a); TMEP section 1402.07(e). No response is necessary unless there is an objection to the amendment. If there is an objection to the amendment, the applicant should notify the examining attorney immediately.

The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.

Recitation of Services – Misclassified and Properly Placed In International Class 41

The applicant has amended its recitation of services to the following:

“Providing news in the nature of current events reporting regarding local community announcements, public safety and missing children matters, brochures and advertisement information regarding local shops, stores and sites for local customers, brochures and advertisement information regarding local and general interest subject matters, recipe cards, rebate cards, magazine subscription cards, and free advertisement cards for use by local customers, all distributed via information literature wall display racks and spinners located within retail outlets” in International Class 42.

Please note, the recitation of services is deemed to be acceptable, but has been misclassified and is properly placed in International Class 41.

As such, the recitation is amended as follows:

“Providing news in the nature of current events reporting regarding local community announcements, public safety and missing children matters, brochures and advertisement information regarding local shops, stores and sites for local customers, brochures and advertisement information regarding local and general interest subject matters, recipe cards, rebate cards, magazine subscription cards, and free advertisement cards for use by local customers, all distributed via information literature wall display racks and spinners located within retail outlets” in International Class 41.

Please note, the international class placement of goods and services is at the sole discretion of the United States Patent and Trademark Office.
