This letter responds to the applicant’s communication filed on June 13, 2003.

Applicant’s amended recitation of services is accepted and entered into the record. Applicant’s amendment to allege use and specimens have been accepted.

Applicant is requesting reconsideration of a final refusal with respect to a disclaimer requirement dated December 13, 2002.

The examining attorney has carefully reviewed the request for reconsideration and has determined that no new facts or reasons have been presented that are significant or compelling with regard to the point at issue. Accordingly, the final action is maintained as written and the request for reconsideration is denied. Applicant should note the additional attached dictionary definitions; said definitions clearly show the descriptive nature of the wording.

The time for appeal runs from the date the final action was mailed. 37 C.F.R. §2.64(b); TMEP §715.03(c).
