Second Action

The Office has reassigned this application to the undersigned examining attorney.

This letter responds to the applicant's communication filed on September 16, 2002.  The examining attorney withdraws that there may be a likelihood of confusion with Application Nos. 75436758 and 75436760.  The examining attorney maintains the Section 2(e)(1) refusal.

IDENTIFICATION OF GOODS

The examining attorney accepts the amended identification of goods.  The examining attorney apologizes for any inconvenience but the previous examining attorney suggested that the goods belong in class 17.  The proper class for “fiberglass reinforcing fabrics for printed circuit board substrates” is class 24; the applicant should amend the classification accordingly.

REQUEST FOR INFORMATION

The applicant must answer the following questions and requests.

1.      The applicant must submit a sample of the fabric.

2.      The applicant must specify the denier or the threads per square inch of the fabric.

3.      The applicant must specify the thickness of the fiberglass thread that is used in the fabric.

4.      The applicant must explain how the fabric is manufactured.

5.      The applicant must submit advertising and promotional material for the fabric.

6.      The applicant must indicate if MICRO has any meaning in the fabric, computer or relevant trade; if so, the applicant must provide a detailed answer.

7.      The applicant must indicate if FINE has any meaning in the fabric, computer or relevant trade; if so, the applicant must provide a detailed answer.

8.      The applicant must indicate if any of its competitors use the term MICRO or FINE or MICROFINE in their product names; if so, the applicant must provide a detailed answer.

37 C.F.R. §2.61(b); TMEP §§814 and 1402.01(d).
