This letter responds to the applicant’s communication filed on December 29, 2003.

 

The amended recitation of services for Class 36 is acceptable.  However, the Class 35 services contains a service that is inaccurate and misclassified.  The “financial analysis and consultation”, in fact, deals tangentially with finances but primarily with products.  Correspondingly, the services must be renamed to be “product analysis and consultation, namely, analyzing medical technology, devices, and drugs for the purpose of reporting to member hospitals on their features and cost effectiveness”.  Further, these services are in Class 42, rather than in Class 35.  Applicant is required to amend the recitation of services to clearly specify the services, classify the services as Class 42 services, and either add the Class 42 services to the application or delete these services.
