This Allegation of Use is being filed after a Notice of Allowance has issued.

The applicant, Castaggeroni, Hector Wenceslao, residing at Virasoro 2125 , (2000) Rosario, Santa Fe, AR , is using or is using through a related company or licensee the mark in commerce on or in connection with the goods and/or services as follows:

For International Class: 012, the applicant, or the applicant's related company or licensee, is using the mark in commerce on or in connection with all goods and/or services listed in the application or Notice of Allowance.
The mark was first used by the applicant, or the applicant's related company, licensee, or predecessor in interest at least as early as 07/03/1997, and first used in commerce at least as early as 09/10/2002, and is now in use in such commerce. The applicant is submitting one specimen for the class showing the mark as used in commerce on or in connection with any item in the class, consisting of a(n) The specimen is a digital color photograph of the front and rear covers of a six-page four-color brochure displaying the mark and photographs of the goods, and full text explaining about the goods bearing the mark in English, Spanish and Portuguese. The brochure displays the mark in association with photographs of the goods, also showing the goods displaying the mark. The goods displayed in the specimen is a 51 foot motor yacht. The specimen brochure accompanies the goods when shipped in Commerce into the United States from point of manufacture outside of the United States. The specimen brochure is displayed with the goods at the point of offering and sale to explain the features of the goods. The mark is shown in the brochure applied to and in direct association with the goods on the brochure front cover, where the photograph shows the mark displayed on the side of that part of the goods known as the "flying bridge", also in association with another device which is also displayed on the bottom of the brochure cover but which is not part of the trademark in this case. The device is mentioned only as a special point of reference and for no other purpose. Applicant notes that on September 17, 2003 Applicant's Second Extension Request was Approved in a writing issued by the Office, but the information is not posted on the TARR Database as of the date of this Statemetn of Use, September 19, 2003..

Applicant requests registration of the above-identified trademark/service mark in the United States Patent and Trademark Office on the Principal Register established by the Act of July 5, 1946 (15 U.S.C. Section 1051 et seq., as amended). Applicant is the owner of the mark sought to be registered, and is using the mark in commerce on or in connection with the goods/services identified above, as evidenced by the attached specimen(s) showing the mark as used in commerce.
