Petition to the Director under Rule §2.146 relating to post-registration matters

 

Registrant hereby petitions, in accordance with the terms of 37 C.F.R. §2.146, for a withdrawal of the Section 15 declaration from the combined Sections 8&15 declaration filed with the Office in the subject registration.

Registrant, through its undersigned attorney, filed a combined Sections 8&15 declaration and specimen with the Office on March 4, 2010.  It was due to the undersigned attorney’s inadvertent error to file a combined Sections 8&15 declaration, and only the Section 8 declaration of use should have been filed.  It was an honest and inadvertent mistake, and there was no intent to deceive the office in filing the combined declaration.

The undersigned has checked all of the appropriate facts, including the fact that only a Section 8 declaration of use would have been filed but for an inadvertent and unintentional error of the undersigned, and the undersigned can state with first-hand knowledge that the filing of the combined Sections 8&15 declaration was unintentional.

This petition is filed within two months from the date when the combined declaration was filed, and within a reasonable time after the mistake was made.  Thus the undersigned has shown due diligence in her effort to correct the mistake. TEMP 1705.04

The undersigned declares that:

She is authorized to make this declaration on behalf of the registrant; and

All facts set forth in this declaration are true; all statements made herein of her own knowledge are true; and further, these statements were made with the knowledge that willful false statements and the like so made are punishable by fine or imprisonment, or both, under Section 1001 of Title 18 of the United States Code and that such willful false statements may jeopardize the validity of the application or document or any registration resulting therefrom.

The undersigned respectfully requests granting of this petition and further requests that a section 15 declaration be withdrawn from the combined Sections 8&15 declaration filed with the Office on March 4, 2010.

The petition fee of $100.00 as set forth in 37 C.F.R. §2.6 is submitted hereto.  If the amount of this fee is insufficient, please charge any deficit to deposit account no. 02-4035.
