This letter responds to the applicant’s communication filed on December 17, 2002.

 

Classification

 

The applicant’s amendment to the classification of services is accepted.

 

Recitation of Services

 

The amended recitation of services is noted.  However, the proposed amendment unacceptable because the wording “ integrated human capital software platform, used for the automation of learning management processes, etc.” designates services that are not within the scope of the identification that was set forth in the application at the time of filing.  While an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §§1402.06 et seq. and 1402.07.  Therefore, the applicant may amend the recitation to read as follows, if accurate:

 

“Personnel management, namely, employee management system used for assessment, development planning, employee appraisal, performance  rewards, mentoring, and career planning,” in International Class 35.

 

Suspension

 

Once the applicant has addressed the issue discussed above, the application will be suspended pending the disposition of Application Serial No. 75734196.  A copy of information relevant to this pending application has been previously sent.
