For International Class 009, the mark is in use in commerce on or in connection with all goods/services, or to indicate membership in the collective membership organization, listed in the existing registration for this specific class: Electronic apparatus for flight control and guidance of missiles, namely seekers, sensors, detectors, processors, and transmitters for missile flight control and guidance, and computer hardware and computer software for use in the operation of guided missiles ; or, the owner is making the listed excusable nonuse claim.

The owner is submitting one(or more) specimen(s) showing the mark as used in commerce on or in connection with any item in this class, consisting of a(n) product brochures (fact sheets) and screenshots of Registrant's website containing ordering information for the goods. It is not customary in the trade to apply the mark directly to the goods, and the nature of the goods is such that it is impossible to place labels or hang tags on the goods. Instead, the mark is used on printed brochures that are available on Registrant's website and are also distributed at military shows, on advertising materials, web sites, other materials made available or provided to members of Congress or their staffs, governmental procurement and other agencies, military authorities and military historians, members of the press, and in other ways that are customary in the trade. Thus, as permitted under Section 45 of the Trademark Act, the mark is used on documents associated with the goods or their sale. The two-page brochure submitted as a specimen is among those distributed to persons who make the purchase decision, namely members of the military, members of Congress, and other authorities of the U.S. and foreign governments.
