The applicant filed a response requesting reconsideration of the Final Refusal on September 3, 2002. The examining attorney has carefully reviewed the applicant’s amendments in favor of registration. The verified substitute specimens for International Classes 36 and 42 have been accepted and entered into the record. As to the outstanding identification and classification issues, the examining attorney has determined as follows.
In accordance with the authorization granted by TMEP section 707.02, the application has been AMENDED as indicated below. No response is necessary unless there is an objection to the amendment. If there is an objection to the amendment, the applicant should notify the examining attorney immediately.
In both the first and second Office actions, the examining attorney specifically indicated that the services, “providing a website featuring information concerning horse racing,” were properly classified in International Class 41. However, in its request for reconsideration, the applicant has again misclassified such services. Consequently, pursuant to TMEP section 707.02, the classification of said services has been amended from International Class 36 to International Class 41.
FEE INCREASE EFFECTIVE JANUARY 1, 2003 (FOR INFORMATION ONLY)
Effective January 1, 2003, the fee for filing an application for trademark registration will be increased to $335.00 per International Class. The USPTO will not accord a filing date to applications that are filed on or after that date that are not accompanied by a minimum of $335.00. Additionally, the fee for amending an existing application to add an additional class or classes of goods/services will be $335.00 per class for classes added on or after January 1, 2003.
