Response To Office Action for Post-Registration Matters

Registration no. 2921075 SIGNA SIGN(Standard Characters, see ) has been amended as follows: RESPONSE TYPE Response to Office Action for Section 7 Request for Amendment or Correction of Registration Certificate.

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The party who filed the Section 7(h) Request for Correction must establish its ownership of the subject registration. 37 C.F.R. ?3.73(b). Accordingly, Registrant herein sets forth the basis for the amendment caused by a typographical error in the original application. Simply put, Universal Lighting Technologies, Inc. never existed. Instead, it should have been listed as Universal Lighting Technologies, LLC., a Delaware LLC. Per TMEP ?502.01, the current owner of the registration to file the Section 7(h) Request for Correction. 15 U.S.C. ?1057(h). The filer of the Section 7(h) Request for Correction clarifies its name and ownership of the subject registration. The owner?s name on the registration is identified as Universal Lighting Technologies, Inc., but the party who filed the Section 7(h) Request for Correction is identified as Universal Lighting Technologies, LLC. If there is a mistake in the manner in which the owner?s name is set forth in the registration, the owner may amend the Section 7(h) Request for Correction to add a request to correct the owner?s name. However, the registration may not be amended to substitute another entity as the registrant. The original entity was a typ that never existed. Per Section 7(h), the mistake occurred in good faith. A Declaration is provided under 37 C.F.R. ?2.20. 15 U.S.C. ?1057(h); 37 C.F.R. ?2.175(b). No additional fee is required, since the fee for a Section 7(h) Request for Correction has already been submitted.
