NOTICE OF SUSPENSION

 

This letter responds to the applicant’s communication filed on 4-10-03.

 

The applicant argues that it does not need to file an assignment since the name originally submitted on the application was a typographical error.  This is not acceptable.  The name on the application, the drawing page and all subsequent correspondence both from the applicant and the Trademark Office for the last two and one half years shows the name as United Lighting Technologies, LLC.   The fact that the name on the check is different is not dispositive.  The applicant must file a change of name with the assignment branch.

 

It is noted that an assignment involving this application is presently pending before the Office. Action is suspended on this application pending recordation of the assignment.  This application will be removed from suspended status upon recordation of the assignment. Notification of recordation is normally done through Office channels.  However, upon receipt of the reel and frame number of the assignment, applicant should advise the Examining Attorney. See 37 C.F.R. Part 3.
