NOTICE OF SUSPENSION

 

The applicant’s response to the first Office action was filed on March 28, 2002 along with a request to divide the application.  The request to divide was completed on June 15, 2002 (with the services in International Classes 37, 40 and 42 remaining in this parent application).  Following the completion of the request to divide, the application was subsequently misfiled by this Office and was only recently returned to the examining attorney for review.  The examining attorney regrets any inconvenience to the applicant. 

 

The examining attorney has reviewed the applicant’s amendments and arguments in favor of registration.  The amended recitations of services in International Classes 37, 40 and 42 have been accepted and entered into the record, and the applicant’s election to proceed on both its Section 1(b) and 44(d) priority bases has been noted.  Further, the likelihood of confusion refusal has been withdrawn. 

 

Action on this application is suspended pending receipt of a certification or certified copy of the registration in the country of origin of applicant.  If the registration is in a foreign language, an English translation must be submitted. The certification or certified copy of the registration should be forwarded to the Examining Attorney as soon as possible.  If the foreign application is abandoned, the Examining Attorney should be advised.

FEE INCREASE EFFECTIVE JANUARY 1, 2003 (FOR INFORMATION ONLY)

Effective January 1, 2003, the fee for filing an application for trademark registration will be increased to $335.00 per International Class.  The USPTO will not accord a filing date to applications that are filed on or after that date that are not accompanied by a minimum of $335.00.  Additionally, the fee for amending an existing application to add an additional class or classes of goods/services will be $335.00 per class for classes added on or after January 1, 2003.
