This letter responds to the applicant’s communication, filed in this Office on May 20, 2003, in which the applicant:  (1) filed an Amendment to Allege Use; and (2) indicated that the applicant wishes to rely solely on the Section 1 basis, while still retaining the foreign priority date.

 

The applicant’s Amendment to Allege Use is acceptable, as is the applicant’s decision to not perfect the Section 44 basis.

 

However, in reviewing the entire file, the examining attorney finds that the previous examining attorney failed to issue a surname refusal, and also suggested an amendment to the identification of goods that exceeded the scope of the original identification.  The translation requirement is also not applicable to this application, and must be deleted.  Accordingly, these new issues are now raised, and this action is thus non-final in nature.  The examining attorney apologizes for any inconvenience to the applicant, and encourages the applicant to resolve these issues by Examiner’s Amendment, in order to expedite processing of the application.

 


 

Surname

 

The examining attorney refuses registration on the Principal Register because the mark is primarily merely a surname.  Trademark Act Section 2(e)(4), 15 U.S.C. Section 1052(e)(4); TMEP section 1211.  The examining attorney must consider the primary significance of the mark to the purchasing public to determine whether a term is primarily merely a surname.  In re Kahan & Weisz Jewelry Mfg. Corp., 508 F.2d 831, 184 USPQ 421 (CCPA 1975). 

 

In this case, please see the attached LEXIS/NEXIS evidence establishing the surname significance of SAPUTO, with the results showing 500 listings of this surname.  Moreover, the fact that the applied-for mark also includes the term “INGREDIENTS” does not affect the surname determination.  It is well established that combining a surname with a generic term does not overcome a mark’s surname significance.  See In re Hamilton Pharmaceuticals Ltd., 27 USPQ2d 1939 (TTAB 1993) (HAMILTON PHARMACEUTICALS held primarily merely a surname for “pharmaceutical products”); In re Cazes, 21 USPQ2d 1796 (TTAB 1991) (BRASSERIE LIPP held primarily merely a surname when used in connection with “restaurant services”); In re Woolley’s Petite Suites, 18 USPQ2d 1810 (TTAB 1991) (WOOLLEY’S PETITE SUITES held primarily merely a surname for hotel and motel services).  Here, the applicant is literally marketing various products that are for use as ingredients in the manufacture of various foods.  Accordingly, the additional term “INGREDIENTS does not take the applicant’s mark out of the surname category.

 

Finally, the examining attorney emphasizes that the surname determination in this case is entirely consistent with the treatment of the applicant’s companion applications.  The three applications for the mark SAPUTO (two in typed form and the other in a script lettering) have all been amended to either the Supplemental Register or the Principal Register under Section 2(f) based on the clear surname significance of SAPUTO.  And the applicant’s other applications and prior registration all contain design elements or an additional nondescriptive slogan that takes those marks out of the surname category.

 

Accordingly, for the above reasons, the examining attorney concludes that the mark is primarily merely a surname, such that registration must be refused on the Principal Register under Section 2(e)(4).

 

Option to Amend to Supplemental Register

 

Although the examining attorney has refused registration on the Principal Register due to the surname significance of the mark, the applicant has filed an Amendment to Allege Use and thus may amend the application to seek registration on the Supplemental Register in order to overcome the refusal.  Trademark Act Section 23, 15 U.S.C. Section 1091; 37 C.F.R. Sections 2.47 and 2.75(a); TMEP sections 202.02(b) and 1115.

 

If the applicant chooses this option, the amendment to the Supplemental Register may be entered by Examiner’s Amendment.

 

 

Although the examining attorney has refused registration, the applicant may respond to the refusal to register by submitting evidence and arguments in support of registration.

 

Identification of Goods

 

The original identification of goods read as follows:  “by-products of milk, namely:  whey protein concentrate, whey, lactose used in the manufacturing process of ice cream mixes, confectionary, soup and sauce bases.”

 

In the initial Office action, the previous examining attorney required that the identification be clarified and that the goods be properly classified.  Several suggestions in different classes were provided, including “lactose to be used in the manufacture of foodstuffs” in Class 1.  The applicant adopted this wording for part of the amended identification.  The current identification, as amended, reads as follows in its entirety:

 

            Class 1:         Lactose to be used in the manufacture of foodstuffs

 

            Class 29: By-products of milk, namely, whey protein concentrates for use in the manufacturing of ice cream mixes; soup

 

            Class 30: Confectionery, namely, chocolate, candy, cakes; sauce bases

 

This examining attorney has carefully reviewed the amended identification, and finds that it is still unacceptable, and must be clarified as follows.

 

(1) First, the Class 1 amendment is clearly outside the scope of the original wording.  The original reference to “lactose” specified that such goods were “used in the manufacturing process of ice cream mixes, confectionary, soup and sauce bases.”  As will be discussed in the following paragraph, it is not clear whether all of the wording after “lactose used in the manufacturing process of” was referring to foods made using the lactose; however, it is clear that the suggestion in the initial Office action of “lactose to be used in the manufacture of foodstuffs” is much broader than the original, since “foodstuffs” would include many more goods than those listed in the original description of this item.  Accordingly, the applicant must amend the Class 1 portion of the identification to limit the wording after “manufacture of” to any or all of the food products listed in the last part of the original identification.

 

(2) The examining attorney also finds that the original identification was unclear with regard to whether all of the wording in the last part of the identification after “lactose used in the manufacturing process of . . .” was all listing the products that are made using the lactose, or whether some of those items were intended to be listed as finished products.  It appears that the previous examining attorney assumed that the “lactose used in the manufacturing process of ice cream mixes” was a particular item, followed by “confectionery,” “soup” and “sauce bases” as three other separate finished food products (which is why the previous examining attorney suggested that the “confectionery” and “sauce bases” be classified in Class 30, and the “soup” in Class 29). 

 

However, in light of the nature of the mark – with the reference to “INGREDIENTS” appearing to indicate that the mark is being used on ingredients, not finished foods such as soup and chocolate – the examining attorney finds that the applicant must clarify this portion of the original identification for the record.  If the applicant responds to this issue by confirming that the mark is being used not only on the lactose and whey protein concentrates (which serve as ingredients) but also on the finished foods listed as “soup,” “chocolate, candy, cakes” and “sauce bases,” then those portions of the identification may remain unchanged.  On the other hand, if these items were intended solely as part of the list of foods made with the “lactose” ingredient, then the identification must be amended to delete “soup” from Class 29 and to delete all of Class 30.  The references to “soup,” “chocolate, candy, cakes” and “sauce bases” would then be included as part of the listing of products made with the “lactose” and/or the “whey protein concentrates.”

 

Please telephone the examining attorney if any of the above discussion is unclear.

 

(3) Finally, the examining attorney notes that the original identification included the term “whey” – with this item being acceptably worded in Class 29.  However, the previous examining attorney did not include that item in any of her suggested amendments (probably because the term was acceptable).  Therefore, because the applicant essentially adopted the exact wording provided in the suggestions in the initial Office action, the term “whey” was deleted from the applicant’s amendment.  Accordingly, the applicant must indicate whether it intentionally deleted “whey,” or whether that item should be reinserted in the Class 29 portion of the identification.

 

Please note, in making the above amendments, that while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. Section 2.71(b); TMEP section 1402.06.  Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.

 

Translation Statement Must be Deleted

 

The previous examining attorney required that the applicant enter a translation of all foreign wording in the mark.  The applicant responded with a translation of the term “SAPUTO.” 

 

The examining attorney finds that a translation is not appropriate in this case.  In the applicant’s companion applications for the same mark, the translation statements have been deleted because the clear significance of the term SAPUTO is as a surname, not as the past tense of an Italian verb.  In this regard, the examining attorney also notes that this Office’s Translation Department has confirmed that the term SAPUTO in the mark is properly regarded as a surname and would not be accurately translated as listed in the applicant’s translation statement.

 

Accordingly, the examining attorney finds that the translation statement must be deleted from the application.
