On April 1, 2002, action on this application was suspended pending the disposition of Application Serial Nos. 1504349 76223177 76119794 76098070 75359620 75375295 75375294.  Referenced pending application serial number 76119794, 76098070 and 75359620 have abandoned and are no longer a bar to the registration of applicant’s mark.  Prior pending application serial numbers 76223177, 75375295 and 75375294 have registered; the examining attorney has reviewed the record and determined she will not refuse registration on the basis of registrations that issued from those applications.  Refusal under Section 2(d) on the basis of Reg. No. 1504349 is withdrawn as that registration has been cancelled.  Save the amendment of the identification herein, all outstanding issues have been resolved.

 

DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Mark S. Graham on October 27, 2010, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

The identification of goods is amended to read as follows: 

 

 

“Manufactured homes.”
