The examining attorney regrets to inform the applicant that the application has been withdrawn from publication as a result of the following issues pertaining to the identification of goods:
The goods “brushes for cleaning plumbing fittings” were classified incorrectly in International Class 8 as hand tools. These goods are classified in International Class 21. The applicant must amend the application to classify the goods in International Class 21. 37 C.F.R. §§2.32(a)(7) and 2.85; TMEP §§1401.02(a) and 1401.03(b). The application does not currently feature International Class 21 as an active class. Therefore, the applicant must either: (1) restrict the application to the number of class(es) covered by the fee already paid, or (2) pay the required fee for each additional class(es). 37 C.F.R. §2.86(a)(2); TMEP §§810.01, 1401.04, 1401.04(b) and 1403.01.
Effective January 1, 2003, the fee for filing a trademark application is $335 for each class. This applies to classes added to pending applications as well as to new applications filed on or after that date. 37 C.F.R. §2.6(a)(1).
In addition, the wording “brushes for cleaning plumbing fittings and pipes for the application of plumbing sealants” is also unacceptable in International Class 8 as pipes may be classified in more than one International Class. It is unclear whether there is additional wording that is missing from the identification in connection with these goods or whether the brushes are the goods and they are used in connection with pipes for the application of sealants. The applicant must submit additional information to permit proper consideration of the application. 37 C.F.R. §2.61(b); TMEP §§814 and 1402.01(d).
The applicant must submit additional information concerning the services identified as “planning of wood” to permit proper consideration of the application. 37 C.F.R. §2.61(b); TMEP §§814 and 1402.01(d). In addition, the services of “cuffing” are unacceptable as indefinite. If this wording appeared in the applicant’s last response in error and the services should be “cutting” and “planing,” the applicant should correct these errors.
Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, the applicant may not amend to include any services that are not within the scope of the services recited in the present identification.

The applicant should simply set forth the required changes or statements and request that the Office enter them. The applicant must sign the response.
