This letter responds to the applicant’s communication filed on 6/15/04.

 

The substitute specimen is acceptable.  The requirement is withdrawn.

 

However, the following issue must be addressed before the mark can be approved for allowance.  Every attempt is made to raise all issues in the first office action after the statement of use is filed.  However, the following issue was omitted. The examining attorney apologizes for any inconvenience this may cause the applicant.

 

Date of Use In Commerce Unclear

 

 An application based on use of the mark in commerce under Trademark Act Section 1(a), 15 U.S.C. §1051(a) must include a date of first use of the mark in commerce.  The application states this date as “JUNE”.  Applicant must indicate the at least year of first use in commerce for this date as well.  Therefore, the applicant must provide a statement specifying the date of first use of the mark in commerce.  Trademark Act Section 1(a)(2), 15 U.S.C. §1051(a)(2); 37 C.F.R. §2.34(a)(1)(iii); TMEP §§903 and 903.02.  The applicant must verify this statement with an affidavit or a declaration under 37 C.F.R. §2.20.  37 C.F.R. §2.71(c).  TMEP §903.05.
