This supplemental action is made necessary because an issue was omitted previously. Further information is set forth below. All other refusals and requirements contained in the office action dated April 20, 2006, are continued.
Identification of Goods
The current wording used to describe the goods needs clarification because it does not identify the diseases or conditions the applicant’s goods are intended to treat. TMEP §1402.01. Pharmaceutical preparations must be identification by the diseases or conditions that they treat, as in “pharmaceutical preparations for the treatment of cancer.”

Please note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of the goods is not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.
The applicant must rewrite the identification of goods in its entirety because of the nature and extent of the amendment. 37 C.F.R. §2.74(b).
