Response To Office Action for Post-Registration Matters

To the Commissioner for Trademarks:

Registration no. 2536354 SUN VALLEY(Standard Characters, see ) has been amended as follows: RESPONSE TYPE Response to Office Action for Combined Declaration of Use and/or Excusable Nonuse/Application for Renewal under Sections 8 & 9.

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

In the Post Reg Office Action mailed July 2, 2021 (the “Office Action”), the Examining Attorney indicated that the Combined Section 8 & 9 Renewal Application filed on March 26, 2021, cannot be accepted because the post registration filing specifies the Owner/holder’s domicile as a post office box instead of a street address.

In response, Applicant filed a Change of Address or Representative form on July 9, 2021, updating their mailing address to replace the post office box with a street address. The mailing address for the Owner has now been updated to show the correct mailing address in the USPTO records.

Prompt acceptance of the Combined Section 8&9 Renewal Application is respectfully requested.

If the Examining Attorney requires any further changes that could be made by Examiner’s Amendment, Applicant respectfully requests that he telephone the undersigned attorney at: (801) 533-9800.
