MISCELLANEOUS STATEMENT It is believed that the requested amendment of the mark does not constitute a material alteration. The dominant elements of the mark remain the same. The amendment merely is a reversal of the elements of the mark, and the overall consumer impression of the mark remains the same. In a telephone conference on January 6, 2005, Examining Attorney Jeri Fickes stated that she did not believe the proposed amendment would constitute a material alteration of the mark, and that she would be inclined to allow the amendment. The amendment is necessary to conform the mark in the application to the mark as it appears on the specimens of use for Class 41, which are submitted concurrently herewith with a (a) Statement of Use for certain of the Class 41 services, (b) Request to Divide, and (c) Request for Extension of Time to File a Statement of Use for all of the goods and services in all classes of the application.
