| Dear Sir or Madam: Please review the following Request for Reinstatement for the above-referenced Trademark Application submitted pursuant to TMEP 1712.02 and in response to an Office Action dated December 16, 2003. The Office Action states that the deadline to file a Statement of Use or Request for Extension of Time to File a Statement of Use expired on May 13, 2003. Applicant submits that a third Request for Extension of Time to File a Statement of Use was timely filed on May 12, 2003. The attached files are images of such third Extension Request, a certificate of transmission dated May 12, 2003, and a receipt indicating successful transmission of the facsimile of the same date. A fourth Extension Request was timely filed on November 11, 2003, through the Trademark Electronic Application System (TEAS) and a Statement of Use was filed on December 4, 2003, also through TEAS. A review of the TARR database for this mark indicates that such filings were timey received through TEAS. Thus, the filing requirements have been met and Applicant requests reinstatement of this application. If Applicant is not entitled to reinstatement, please consider this request as a petition to revive in accordance with 37 C.F.R. Section 2.66 and charge Deposit Account No. 19-4968 the $100.00 petition fee. Any overpayment or deficiency should be applied to Deposit Account No. 19-4968.
