As stated in a phone message of August 21, 2006, the mark has been withdrawn from publication.  Examining attorney apologizes for any inconvenience caused by raising this additional requirement at this time. 

 

 

IDENTIFICATION OF GOODS

                       

Applicant must amend the identification of goods by deleting the wording “TELEX” and substituting the common commercial or generic name for the goods.  The wording “TELEX” in the identification of goods is a registered mark.  See enclosed copy of U.S. Registration No(s). 0902922, 0901195, and 0908989.  Registered marks are not to be used in the application to describe applicant's goods.  TMEP §1402.09.

 

Office paper, namely, writing paper, printed publications, namely, magazines on intellectual property; photographs; letter paper; envelopes; color pens; playing cards; books on strategy for intellectual property, notebooks; catalogues in the field of databases for intellectual property; calendars; greeting cards; trading cards; stickers; newsletters on domain names and intellectual property in International Class 16.

Please note that, while the identification of services may be amended to clarify or limit the services, adding to the services or broadening the scope of the services is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include services that are not within the scope of the services set forth in the present identification.
