As stated in a phone message of August 21, 2006, the mark has been withdrawn from publication. Examining attorney apologizes for any inconvenience caused by raising this additional requirement at this time.
Applicant must amend the identification of goods by deleting the wording “TELEX” and substituting the common commercial or generic name for the goods. The wording “TELEX” in the identification of goods is a registered mark. See enclosed copy of U.S. Registration No(s). 0902922, 0901195, and 0908989. Registered marks are not to be used in the application to describe applicant's goods. TMEP §1402.09.
