The Office has reassigned this application to the undersigned examining attorney.

 

This letter responds to the applicant’s communication filed on 2-21-03.

 

The applicant has (1) provided a substitute specimen and pointed out it is a clear photograph of part of the original specimen showing the proposed mark on the goods and, (2) argued against the Section 2(d) refusal.

 

Number (1) is acceptable.

 

Registration was refused under Trademark Act Section 2(d), 15 U.S.C. §1052(d), because the mark for which registration is sought so resembles the mark shown in U.S. Registration No. 2511291 as to be likely, when used on the identified goods/services, to cause confusion, or to cause mistake, or to deceive.

 

The examining attorney has considered the applicant’s arguments carefully but has found them unpersuasive.  For the reasons below, the refusal under Section 2(d) is maintained and made FINAL.

 

The marks are identical.  Both are for the wording WEBSTER.

 

The examining attorney must consider any goods or services in the registrant’s normal fields of expansion to determine whether the registrant’s goods or services are related to the applicant’s identified goods or services under Section 2(d).  In re General Motors Corp., 196 USPQ 574 (TTAB 1977).  TMEP §1207.01(a)(v). 

 

The applicant argues that registrant’s website indicates its goods are “small, hand-held devices used to transfer photographs and digitally scanned images to a computer or website the mass market.”  The applicant further argues that its goods are used in corporate presentations by sophisticated persons.  However, the identification of goods is not limited to the description provided by the applicant above.  It reads “photographic cameras; digital cameras; imaging devices; and scanners.”

 

The examining attorney must determine whether there is a likelihood of confusion on the basis of the goods/services identified in the application and registration.  If the cited registration describes the goods/services broadly and there are no limitations as to their nature, type, channels of trade or classes of purchasers, it is presumed that the registration encompasses all goods/services of the type described, that they move in all normal channels of trade, and that they are available to all potential customers.  In re Elbaum, 211 USPQ 639 (TTAB 1981).  TMEP §1207.01(a)(iii). 

 

The goods/services of the parties need not be identical or directly competitive to find a likelihood of confusion.  They need only be related in some manner, or the conditions surrounding their marketing be such, that they could be encountered by the same purchasers under circumstances that could give rise to the mistaken belief that the goods/services come from a common source.  In re Martin’s Famous Pastry Shoppe, Inc., 748 F.2d 1565, 223 USPQ 1289 (Fed. Cir. 1984); In re Corning Glass Works, 229 USPQ 65 (TTAB 1985); In re Rexel Inc., 223 USPQ 830 (TTAB 1984); Guardian Products Co., Inc. v. Scott Paper Co., 200 USPQ 738 (TTAB 1978); In re International Telephone & Telegraph Corp., 197 USPQ 910 (TTAB 1978).  TMEP §1207.01(a)(i). 

 

In the electronics field, the decisions have held that the sale of related merchandise under the same or similar marks would be likely to cause confusion in spite of the sophistication and technical background of the purchasers.  Matsushita Electric Industrial Co. v. National Steel Construction Co., 442 F.2d 1383, 170 USPQ 98 (C.C.P.A. 1971); Tac Technical Instrument Corp. v. Fischer & Porter Co., 433 F.2d 827, 167 USPQ 635 (C.C.P.A. 1970); Wincharger Corp. v. Rinco, Inc., 297 F.2d 261, 132 USPQ 289 (C.C.P.A. 1962); Matsushita Electric Industrial Co., Ltd. v. Sanders Associates, Inc., 177 USPQ 720 (TTAB 1973); I‑T‑E Circuit Breaker Co. v. The Industrial Test Equipment Co., 135 USPQ 162 (TTAB 1962).

 

The examining attorney encloses several registrations for goods such as those of applicant and those of registration to demonstrate that the same manufacturer produces such related goods.

 

The refusal under Section 2(d) is maintained and made FINAL.
