The applicant, Marques, Jean Pierre, residing at P.O. Box 180421 , Coronado, CA US 921780421, requests a six-month extension of time to file the Statement of Use under 37 C.F.R. Section 2.89 in this application.    The Notice of Allowance mailing date was 12/31/2002.

For International Class: 009, the applicant has a continued bona fide intention to use or use through the applicant's related company or licensee the mark in commerce on or in connection with all of the goods and/or services listed in the Notice of Allowance, or as subsequently modified.

This is the second extension request.   The applicant has made the following ongoing efforts to use the mark in commerce on or in connection with each of those goods and/or services covered by the extension request: This second extension request is a substitute extension request in response to an Intent to Use Office Action with a mailing date of March 4, 2004 received from Pamela V. Smith in the ITU/Divisional Unit. The The video tapes on which Applicant intends to use the mark in commerce are instructional video tapes. Applicant's ongoing efforts to use the mark in commerce include, but are not limited to, the following: Applicant has held meetings to determine the content for the video tapes and to determine how the market, sell and distribute the video tapes. Applicant choreographed an exercise routine and hired a videographer to record the exercisie routine on the video tapes. Applicant hired performers to provide instruction and to perform the exercise routine on the video tapes. Applicanat has recently produced a master copy of the video tape on which the mark will be used in commerce and is in the process or replicating the video tapes to be used in commerce. Applicant has a bonafide intent to begin using the mark on the video tapes in commerce in the immediate future..

The applicant hereby appoints T. Steven Gregor of  Dorazio & Gregor LLP, 16236 San Dieguito Road,#4-21 , Rancho Santa Fe, CA USA 92067 to submit this Request for Extension of Time to File a Statement of Use on behalf of the applicant.

A fee payment in the amount of $150 will be submitted with the form, representing payment for 1 class.
