EXAMINER’S AMENDMENT

 

In accordance with the authorization granted by TMEP Section 707.02, the application has been AMENDED as indicated below.  Please note that if the identification of goods or services has been amended below, any future amendments must be in accordance with 37 C.F.R. 2.71(a); TMEP section 1402.07(e).  No response is necessary unless there is an objection to the amendment.  If there is an objection to the amendment, the applicant should notify the examining attorney immediately.

 

The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Recitation of Services

The recitation of services is unacceptable as indefinite.  The applicant must amend the recitation to indicate the nature of the services and their particular field.  TMEP section 1301.05.  The services listed in International Class 35 are acceptable as written.

 

The applicant may adopt the following recitation of services, if accurate: 

 

Entertainment services in the nature of exhibitions, toy displays, toy demonstrations, sports games, namely gymnastics, swimming, baseball, software, T-ball, basketball and games of skill; food tasting displays, beverage tasting displays, fireworks displays, displays of new technology, new products, and scientific developments, educational displays, crafts displays, displays of cooking and candy making, talent shows, magic shows, air shows, vehicle shows, puppet shows, vocal or instrumental music contests, dancing contests, trivia contests, animal shows, art exhibits, amusement park services, theme parks, museum services, live musical performances, on-going radio and television programs featuring children's programs, education, charitable causes, history, science, culture and technology, variety programs, news, and ongoing television programs featuring animated characters, production and distribution of motion pictures, providing information in the fields of entertainment, television, and motion pictures in International Class 41; and

 

Providing information in the fields of current events, history, children, toys, animals, art, books, stuffed and plush toy animals and accessories therefor, and clothing by means of a global computer network in International Class 42
