Serial Number  76/163623

This letter responds to the applicant’s communication filed on May 19, 2003.  Applicant’s intent to use basis has been deleted, and the Section 44 basis inserted.  However, please note the following:

Foreign Registration Expired (or Due to Expire)

The foreign registration on which the goods “electronic computers” and “cash registers” in this application is based (Reg. No. 669501) will expire on December 13, 2003.  The applicant must submit evidence that the foreign registration will be in force at the time of issuance of the United States registration.  The evidence must consist of an official certification or a true copy, a photocopy, a certification, or a certified copy of the certificate of registration showing that the foreign registration has been renewed.  37 C.F.R. §2.34(a)(3)(iii); TMEP §1004.01(a).

The registrations that all the other goods are based on are still in force.  Therefore, instead of submitting evidence that the foreign registration will be in force at the time of issuance of the United States registration, the applicant may instead drop the goods “electronic computers” and “cash registers” from the application and proceed with the remaining goods.
