Response to Office Action for Post-Registration Matters

To the Commissioner for Trademarks:

The following is submitted for registration number. 2475924 :

FORM INFORMATION

In response to the post registration office action issued on March 16, 2011, Registrant hereby submits two substitute specimens evidencing use of the registered mark.  The substitute specimens consist of digital images of point of sale displays clearly showing the mark in connection with the goods.  Specifically, the point of sale display appears on shelving in a store which also houses the goods.

The Registrant also declares under 37 C.R.R. §2.20 that, "The substitute specimen was in use in commerce during the relevant period for filing the 6-year Section 8," as evidenced by his signature here.

The Registrant respectfully requests that the refusal to accept the Section 8 be withdrawn.
