This letter responds to the applicant’s communication of July 2005.

The applicant’s fee structure is now acceptable; its identification would be better if, due to intervening change in Office policy, the modifier “for the transfer and dissemination of health and wellness information for general users and individual subscribers” were deleted from the end of Class 38.*

TMEP 716.02(e) provides: “The examining attorney cannot withdraw a refusal of registration under §2(d) until the TRAM system shows that the registration has actually been cancelled or expired.
