Pursuant to Section 7(g) and 7(h) of the Trademark Act, Registrant respectfully requests a correction to Registration No. 2868233 issued on
August 3, 2004. During prosecution of the application, the Examining Attorney inserted the language microscopes and spectrocopes at the beginning of the identification. There is no such thing as a
spectrocope and if spectroscopes was intended, the spelling should be a corrected, at a minimum. In addition, however, microscopes and spectroscopes is not the accurate language. Registrant
respectfully requests that the phrase be replaced by electrophoresis gel documentation and analysis apparatus. The identification of goods would then read, in its entirety, as follows: --
Laboratory equipment, namely, electrophoresis gel documentation and analysis apparatus comprised of optical components, namely, cameras and lighting, and computer hardware and computer software for
the acquisition, viewing, archiving and analysis of DNA, RNA, protein and chemiluminescent gel and blots in the field of biotechnology, namely, charged coupled device video cameras, cooled and
non-cooled cameras, ultra-violet and white light transillumination lights, broad band filters for fluorescent applications, electrophoresis apparatus and instruments consisting of gel tanks and power
supplies; and parts and fittings for all the aforesaid goods. -- It is not believed that the requested correction is a material change. It is a more accurate description of the goods. Favorable
action is respectfully requested. Please charge the U.S. Patent and Trademark Office fee of $100 to the undersigneds Deposit Account No. 19-4880. Please charge any deficiency or credit any
overpayment to the undersigneds Deposit Account No. 19-4880. Even if the request for the change in language is refused, correction of the spelling of spectrocopes to spectroscopes, which was
Patent and Trademark Office error, is respectfully requested. |
