NOTICE OF CONTINUED SUSPENSION
SUSPENSION PROCEDURE: This suspension notice serves to suspend action on the application for the reason(s) specified below. No response is needed. 37 C.F.R. §2.67. Action on this application was previously suspended pending the disposition of:
- Civil Action No(s). David Dodart, et al. v. Young Again Products, Inc., Case No: 2:03CV0035) pending in the United States District Court for the Central Division of Utah.
The United States District Court for the Central Division of Utah has now issued a Certified Order of Cancellation ordering, inter alia, the cancellation of Registration No.2478357 (registered to David Dodart and assigned to Young Again Nutrition, LLC), and lifting of the stay in connection with this application (Serial No.76073269).
Pending the actual cancellation of the prior registration, further action on the current application remains suspended. The applicant in the current application is requested to notify the examining attorney of the cancellation of the prior registration as soon as it occurs.
