Response to Office Action for Post-Registration Matters

To the Commissioner for Trademarks:

The following is submitted for registration number. 2508164 FOX HUNT :

FORM INFORMATION

Dear Mr. Rice:

The party who filed the Section 8 Affidavit and the current owner of the registration are one and the same. The chain of title reflects an "assignment" due to name change only. PERFORMANCE IMPACT, INC. changed its name to FOX HUNT STAFFING, INC. The corporate entity did not change, merely the name of the entity changed. The assignment recordation form cover sheet (Doc No. 102112821; filed 6-6-2002) confirms this.

Upon filing the Section 8 Affidavit, when we entered the registration number into the TEAS system, the identified owner shown by the TEAS system was PERFORMANCE IMPACT, INC. We were concerned that if we used the current name of the corporation (FOX HUNT STAFFING, INC.), the TEAS filing would be rejected.

At this point, we are willing to do whatever is necessary to preserve the registration, including paying an deficiency surcharge, if necessary.
