In the April 4, 2012 Suspension Inquiry, the Examining Attorney has requested an update on the status of the civil litigation.

In response to the Suspension Inquiry, please be advised that the related civil litigation is still currently on appeal before the United States Court of Appeals for the Ninth Circuit and the matter has been temporarily stayed. Accordingly, the briefing schedule has not been set, and the continued suspension of examination of this pending trademark application is appropriate.
