EXAMINER’S AMENDMENT

 

In accordance with the authorization granted by Marsha Gentner on April 16, 2004, the application has been AMENDED as indicated below.  Please note that if the identification of goods or services has been amended below, any future amendments must be in accordance with 37 C.F.R. 2.71(a); TMEP section 1402.07(e).  No response is necessary unless there is an objection to the amendment.  If there is an objection to the amendment, the applicant should notify the examining attorney immediately.

 

The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

The identification of goods for International Class 28 and dates of use is amended to read as follows:

 

“Surf boards, trapeze harnesses and snow boards” whose dates of use are first use: September 1981 and first use in commerce February 1985.

 

“Snow board bindings” whose dates of use are first use 1981 and first use in commerce 1983.

 

The date of first use for International Class 18 is 1981.

The following authorities govern the processing of trademark and service mark applications:  The Trademark Act, 15 U.S.C. §§1051 et seq., the Trademark Rules of Practice, 37 C.F.R. Part 2, and the Trademark Manual of Examining Procedure (TMEP).
