The Office received your request for correction of the subject registration submitted on January 30, 2004. The registration will be corrected as to the following errors only: The word ‘services” will be changed to “kiosks” and “trade shows and” will be changed “trade show” Class 35.
Although the issuance of the registration omitted services, namely “providing facilities for exhibitions for commercial and business purposes in the field of luxury goods in the nature of jewelry, silverware, watches, clothing, leather goods, eyeglasses, perfumery, and desk and writing instruments” was the result of an Office error, a certificate of correction of the registration for the remaining corrections cannot be issued under Section 7(g) of the Trademark Act, because the mark did not publish with the correct information as required by Section 12(a) of the Trademark Act, 15 U.S.C. §1062(a).
In order to make the remaining corrections, examination of the amendment by an examining attorney is required. Therefore, if you want these corrections made, you must submit a statement, signed by the registrant or the registrant’s attorney, authorizing the Office to cancel the registration as inadvertently issued, restore it to pending application status, and forward it to the examining attorney for examination.
If the proposed amendment is accepted, the mark will be republished for opposition with the corrected information. If there is no opposition or any opposition filed is unsuccessful, the Office will issue a new certificate of registration. 15 U.S.C. §1057(g). If the proposed amendment is not accepted, then the examining attorney will issue an Office action.
You have six months from the mailing date of this action to submit the additional statement required to complete the request. If you do not respond within the specified time period, then the portion of your request for correction that requires examination will be abandoned and only a partial certificate of correction of the registration will be issued.
