The following issues were discussed in communication with Nadia K. Droumbanis on May 23, 2003.
The recitation of the International Class 41 services includes “conducting entertainment exhibitions in the field of protection of environment”. The applicant must indicate whether these exhibitions are actually educational in nature (services also in International Class 41.) Issues relating to the environment are not typically entertainment oriented in nature. Therefore, in this regard, the applicant should adopt the following if accurate: “conducting educational exhibitions in the field of protection of the environment” in International Class 41. Moreover, the applicant must clarify whether the service of providing facilities for exhibitions in the field of luxury goods, such as jewelry, silverware, watches, etc., is for entertainment purposes as stated, or whether it is actually only for business or commercial purposes, i.e. to promote the sale of said luxury goods. Typically, goods of this nature are not exhibited for entertainment purposes. The application already protects providing facilities for exhibitions in this field for business and commercial purposes. Therefore, the examiner suggests the deletion of the following services from the International Class 41 recitation: “providing facilities for exhibitions for entertainment purposes in the field of jewelry, silverware, watches, clothing, leather goods, eyeglasses, perfumery, and desk and writing instruments.”
