The request for extension of time to file a statement of use (extension request) filed on July 27, 2006, is premature because the notice of allowance that issued on January 24, 2006, was cancelled due to an error by the Office in the electronic processing of the application. A new notice of allowance will issue in due time, therefore; the extension request will not be reviewed. All fees will be refunded in due course.

If a new notice of allowance issues, then applicant must submit an extension request (or a statement of use) within the six month period following the issue date of the notice of allowance in order to avoid abandonment of the application. Applicant is encouraged to submit the extension request (or statement of use) using the Trademark Electronic Application System (TEAS) at http://www.gov.uspto.report/teas/index.html.
