The Section 7(h) Request for Correction submitted on April 06, 2021 is not accepted for the reasons set forth below.

 

I.                Ownership Issues: Corrected Assignment

 

The party who filed the Section 7 Request for Correction has requested that the owner name in the registration be changed to reflect a different owner name.  This party states that ownership has been properly transferred to the new owner.  However, because of what appears to be an error in the ownership documents as filed with the Assignment Recordation Branch, chain of title to the new owner is unclear.

 

Errors in assignment records are corrected by recording a correcting document with the Assignment Recordation Branch of the USPTO.  TMEP §§503.06 et seq.  To expedite recordation, the owner is encouraged to file requests for recordation through the Electronic Trademark Assignment System (ETAS) at http://etas.uspto.gov.  There is a fee for recording ownership documents.

 

You must notify the undersigned paralegal when the corrected document has been submitted for recordation.  The filing of a document with the Assignment Recordation Branch does not extend the time period for responding to this Office action.

 

II.             Response Period

 

The owner has six months from the issuance date of this letter to respond to all the issues raised in this letter.  In order to expedite the processing of your Section 7 Request for Correction, the early submission of a response to this letter is encouraged.  If a complete response is not received in the Office within this time period, then the Section 7 Request for Correction will be considered abandoned.  37 C.F.R. §2.176.
