This Response answers the Post-Registration Office Action issued on June 25, 2020 for Registration No. 2,353,628 (the “Registration”) for the mark USP (the “Mark”) owned by PUMA SE (the “Registrant”). Please see the following remarks.

 

The Examiner issued an Office Action in connection with the Trademark Office Audit Program requesting proof of use for “jackets” and “T-shirts” in Class 25. In response, Registrant submits proof of use evidence attached as Exhibit A.

 

Additionally, Registrant was using the Mark in commerce on or in connection with the goods identified in the Registration for which use of the Mark in commerce is claimed, as evidenced by the submitted proof of use, during the relevant period for filing the affidavit of use.

 

Therefore, Registrant respectfully submits that adequate materials have been provided to satisfy the audit requirements for Registration No. 2,353,628.
