In an action dated April 30, 2001, action on this application was suspended pending the disposition of Application Serial Nos. 75522983, 75611535, 75614874, 75631921, 75674834, and 75679729. None of the aforementioned applications pose a bar to registration of Applicant’s mark.
The Likelihood of Confusion refusals based on U.S. Registration Nos. 1484910, 1916438, 1962439, 2058695, and 2090648 are maintained and continued. The Likelihood of Confusion refusal based on U.S. Registration No. 743773 is withdrawn.
Accordingly, this case has been removed from suspension. Upon subsequent review, the examining attorney has determined the following.

The wording “artificial eyeglasses” in the identification of goods is too broad because it could include items classified in other classes. The applicant must amend the identification to list each item by its common commercial name. TMEP §§1401.04(b), 1402.01 and 1402.03. Non-prescription eyeglasses are classified in International Class 009. Toy eyeglasses are classified in International Class 028.
The wording “educational books” in the identification of goods in International Class 016 is unacceptable. Applicant must clarify the identification of goods to specify the industry or field in which the goods are used or intended to be used. Applicant may adopt the following format for the identification of goods, if accurate: educational books featuring [specify area or subject matter, e.g., elementary level mathematics]. TMEP § 1402.01.
The applicant has classified “book rests” incorrectly. The applicant must amend the application to classify the goods in International Class 020. 37 C.F.R. §§2.32(a)(7) and 2.85; TMEP §§1401.02(a) and 1401.03(b).
The wording “loose-leaf” in the identification of goods is unacceptable as indefinite. The applicant may adopt the following identification, if accurate: loose-leaf paper. TMEP §1402.01.
The applicant has classified “writing tables” incorrectly. The applicant must amend the application to classify the goods in International Class 020. 37 C.F.R. §§2.32(a)(7) and 2.85; TMEP §§1401.02(a) and 1401.03(b).
The applicant has classified paper bath mats incorrectly. The applicant must amend the application to classify the goods in International Class 027. 37 C.F.R. §§2.32(a)(7) and 2.85; TMEP §§1401.02(a) and 1401.03(b).
The applicant has classified plastic place mats incorrectly. The applicant must amend the application to classify the goods in International Class 024. 37 C.F.R. §§2.32(a)(7) and 2.85; TMEP §§1401.02(a) and 1401.03(b).
The applicant has classified playing cards and playing card cases incorrectly. The applicant must amend the application to classify the goods in International Class 028. 37 C.F.R. §§2.32(a)(7) and 2.85; TMEP §§1401.02(a) and 1401.03(b).
The wording “plastic bibs” in the identification of goods in International Class 020 is unacceptable as indefinite. The applicant may adopt the following identification, if accurate: plastic baby bibs in International Class 025. TMEP §1402.01.
The wording “shop-at-home services in the filed of clothing and music” in the recitation of services is unacceptable as indefinite. The applicant may amend this wording to “retail shop at home party services in the field of clothing and music,” if accurate. TMEP §1402.11.
Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.
