| The purpose of this Petition is to correct the record with respect to ownership with regard to the trademark SHARPSHOOTER, Registration No. 2312527.
The Section 8 Declaration and Section 9 Renewal and the Section 15 Declaration of Incontestability were all filed on January 19, 2010 in the name of the registered owner,
Bayer Environmental Science SAS. However, Bayer Environmental Science SAS had ceased to exist as a legal entity as of January 4, 2010. At the time of the filings, the trademark was
actually owned by Bayer SAS. This was due to a merger effective on January 4, 2010 between Bayer Environmental Science SAS, Bayer CropScience SA, and Bayer CropScience France. The
Attorney of Record was not made aware of the merger until March 11, 2010. The merger was officially recorded at the U.S. Patent & Trademark Office on May 7, 2010 on Reel/Frame number
4201/0099. For the foregoing reasons, registrant respectfully requests that the U.S. Patent & Trademark Office correct the owner name at the time of filing the Section 8 Declaration,
Section 9 Renewal, and Section 15 Declaration of Incontestability. |
