The Combined Section 8 Affidavit & Section 9 Renewal Application submitted on September 21, 2009, cannot be accepted for International Class 10, the reasons set forth below.
The Trademark Act requires a Section 8 Affidavit must be filed on or between the 5th and the 6th year anniversary after the date of registration or the date of publication under 15 U.S.C. §1062(c). Because the Combined Declaration of Use and Incontestability Under Sections 8 and 15 only filed International Class 5. Therefore, International Class 10 has been cancelled. The filing fee $500 will be refunded. There is no need to respond to this issue.
