The Post Registration Division issued an office action on January 30, 2019, indicating that the requirements for the previous audit request were not satisfied and
requiring that the registrant provide proof of current use of the mark in commerce in the U.S. in connection with traveling bags, beach bags, trunks, wallets, briefcases, change purses, credit card
cases, key cases and parasols.
Registrant has attached photographs showing current use of the LEONARD mark in connection with travelling bags, beach bags, wallets, briefcases, change purses, credit card cases, and key
cases. We note that the mark is a bit difficult to read on the photo for the briefcase, but the LEONARD mark is etched onto the brass clasp on the front of the briefcase. In the photo of
the traveling bag, the LEONARD mark is visible on the box underneath the bag, which is used as packaging for the bag. For the beach bag, the LEONARD mark is printed on the rectangular tag near
the top of each bag. Registrant has resubmitted one of the original specimen photos to support use of the mark on change purses because the smaller bag in the front of the photo can be used to
carry change, or keys, or other small items.
Registrant requests that trunks and parasols be deleted from the registration as not in current use.
Registrant has already provided specimens supporting use of the LEONARD mark in connection with handbags and umbrellas.
Registrant was using the mark in commerce on or in connection with the goods identified in the registration for which use of the mark in commerce is claimed, as evidenced by the submitted proof
of use during the relevant period for filing the affidavit of use.
The signatory being warned that willful false statements and the like are punishable by fine or imprisonment, or both, under 18 U.S.C. section 1001, and that such willful false statements and
