| Further to the attached Assignment, Concurrent Use & Coexistence Agreement, Ames Safety Envelope Co., Inc. (Assignor)has assigned a portion of
the goods and services under Reg.No. 2,133,853, AMES & design, to Tab Products Co., LLC (Assignee). Assignee is receiving all of the rights under Classes 16 and 20, as follows: (Int'l Class: 16) Paper products, namely, envelopes, file folders and pockets, medical diagnostic film jackets, labels, index tabs and dividers, file and binder inserts, printed forms, adhesive stationery tape, custom printed retail boxes, file and storage boxes, lined and unlined x-ray mailers, anti-static computer diskette mailers, videotape mailers, and computer diskette, compact disk, and video tape sleeves; and non-paper stationery products, namely, binders, clipboards, sheet protectors, file folder paper fasteners, label and tape dispensers, wall-mounted file, chart, and medical diagnostic film holders, file and desk organizers, index card holders and organizers (Int'l Class: 20) Shelving, file cabinets and racks, modular office furniture, office chairs Assignor is retaining all of the rights under Class 40, as follows: (Int'l Class: 40) Custom manufacture of compact disk storage cases The Class 9 goods have previously been abandoned by Assignor under Section 8. The parties' agreement with respect to concurrent use and coexistence is attached hereto for review and reference. The parties hereby request, pursuant to 37 C.F.R. §2.171(b), that Reg.No. Reg.No. 2,133,853, AMES & design, be divided and that Assignee receive the new "child" registrations while Assignor retains the "parent" registrations. The assignment of all properties listed in the attached agreement, including the subject of this divisional request, namely, Reg.No. 2,133,853, AMES & design, has been recorded today, March 23, 2010, with the USPTO. The Receipt ID for the electronic recordation is EASTM167834. |
