In response to the outstanding Post Registration Office Action, Registrant/Owner respectfully submits the following:

1.      The certification mark owner submits herewith a copy of the standards, a copy of which can also be found from the certification owner’s website (www.isc2.org), that are used to determine who is authorized to use the CISSP certification mark.

2.      The owner is exercising legitimate control over the use of the mark in commerce and was exercising legitimate control over the use of the mark in commerce during the relevant time period for filing the Section 8 Affidavit or Declaration.

3.      Pursuant to TMEP Section 1306.04(d)(ii), a certification mark may be used to certify that the work or labor on the goods or services was performed by a member of a union or other organization, or by a person who meets certain standards and tests of competency set by the certifier. 15 U.S.C. §1127.  The certifier need not certify the quality of the work being performed, but only that the work was performed by a member of the union or group, or by someone who meets certain standards. Used in this manner, it is respectfully submitted that the mark certifies a characteristic of the goods or services.

Based thereon, in connection with this CISSP certification mark, the CISSP certification mark is used by persons authorized by the certifier to certify completion of appropriate work experience and/or successfully passing an examination as established by the certifier in the field of security of information systems.

In addition, this CISSP certification mark, as used by persons authorized by the certifier, certifies that the goods and/or services have been provided by persons who have completed appropriate work experience and/or have successfully passed an examination as established by the certifier in the field of security of information systems
.

4.      The owner is not engaged in the production or marketing of the goods and/or services to which the mark is applied, except to advertise or promote recognition of the certification program or of the goods and/or services that meet the certification standards of the owner.

 

Unless the owner specifically claimed excusable nonuse, the mark was in use in commerce on or in connection with the goods/services or to indicate membership in the collective membership organization identified in the registration, as evidenced by the submitted specimen(s) showing the mark as used in commerce, during the relevant period for filing the 10-year Section 8.

The signatory being warned that willful false statements and the like are punishable by fine or imprisonment, or both, under 18 U.S.C. §1001, and that such willful false statements and the like may jeopardize the validity of this submission, declares that all statements made of his/her own knowledge are true and that all statements made on information and belief are believed to be true.
